CAREFULLY READ ENTIRE CONTRACT TO FULLY UNDERSTAND DIRECTIONS, RULES AND LIABILITES ASSOCIATED WITH THE RENTAL OF JOLLY BOUNCERS UNITS.
Call Jolly Bouncers immediately if there is an issue. We will not refund without an opportunity to correct  problem
 
Payments are generally CASH or CHECK at Drop Off (prices include a 3% cash/check discount- add 3% back for Credit)
Do not use more than 50' of electrical cord (25ft on the blower + 25ft extention) or the unit will be soft. There is also a chance the circuit will be overloaded. If unit is placed more than 50ft from outlet, a generator should be rented. If customer requires over 50ft of electrical cords instead of the generator, customer accepts responsibility for both a soft unit or a blown circuit.
Only plug into 15 or 20amp designated circuit (nothing else plugged into the circuit).
Price includes std delivery. Additional charge will apply for stairs/ hills, if set up is more than 60' from parking, other non-std issues) 
Cancel within 24 Hrs of booking or $50 fee on orders less than $100 or 50% on orders over $100. This amt can be deducted on your next order. 
Adult supervision is absolutely required at all times. Jolly Bouncers offers attendants for $20/hr based on availability.
If the unit is set up on grass, show the driver exactly where to place unit- away from sprinkler lines. If a sprinkler line is broken we charge $50 to repair.
Client is responsible for park permit if one is required.
Water Option: Water Slides ordered dry may be used with water for additional $75.
Margarita Machine: Customer to provide 3 gall chilled water per side + Alcohol. Machine must be plugged directly into outlet (no extension cords).
If the wind is over 25mph, or the stakes/sandbags are moving, please deflate the bouncer until the wind lets up (Make sure bouncer is empty and then turn off power to the blower).
 
1. RULES:  An attendant or adult must supervise riders at all times and enforce the following rules.  If an attendant is not available, a Jolly Bouncers attendant may be hired for $20/hr (based on availability).  AS THE LESSEE OF THE JOLLY BOUNCERS UNIT,  THE SAFETY OF ALL RIDERS IS YOUR RESPONSIBILITY. If you become aware of any potentially dangerous condition, correct the action of participants or notify JOLLY BOUNCERS immediately.
            Only compatible age groups and sizes shall play on the Jolly Bouncers unit at the same time.
      The maximum # of riders of each group that should play on the Jolly Bouncers unit at one time are:

· The Jolly Bouncers unit should never be moved from the place it was installed.
· CLEANING: If non-standad cleaning is required, a $100 (or more) cleaning fee will automatically be charged to the credit card.
 
2. EQUIPMENT, RENTAL & TERMS OF RENTAL  AGREEMENT: The undersigned, as lessee, hires from JOLLY BOUNCERS, Inc. as lessor, one or more JOLLY BOUNCERS unit. The rental fees as stated above is payable in advance from the time of commencement, start time to end time.
 
3. DELIVERY: Delivery is to the street address specified above by lessee (customer). Lessee grants lessor right to enter the property at the said street address (delivery address) for the delivery and subsequent pick up of the JOLLY BOUNCERS unit at the specified time. Non-standard deliveries (set up location over 50ft from drop off location, stairs, hills, etc.) will have a delivery expense added. In the event that the JOLLY BOUNCERS unit is not ready for return at the appointed time and the driver must return, a $50.00 Transportation Fee shall be automatically imposed. 
 
4. GENERATOR: 
· The generator should never be left unattended at any time.
· Keep all children away from the generator.  It is hot while running and the exhaust could be dangerous.
· Generator should not be moved from the position it was left by the lessor.
· Only an adult may turn the generator on or off in the event the bouncer is not being used.
· Generator must be placed in an area that is free of brush and other items that may be flammable.
· Generator is to be placed at least 3 feet from any type of wall.  The generator needs proper ventilation.
 
5. IF THERE ARE ANY ISSUES OR PROBLEMS OR IF THE UNIT BEGINS TO DEFLATE:
· The motor may have stopped. Check the cord connection at the outlet near the motor. If the motor is continuing to run, check the air intake on the side of the motor for blockage. 
· Check both air tubes at the back of the JOLLY BOUNCERS unit for snugness. Re-tie if necessary. 
· Check fuse box in case a circuit shorted out. Blower must be alone on at least a 15-amp designated circuit.  20-amp outlets are usually found in the kitchen and laundry room.  We recommend renting a generator if the unit is placed farther than 50 ft from a plug. Using more than 50' of extension cord may blow circuit. 
Call Jolly Bouncers immediately if above solutions do not correct problem.
We will not refund without the opportunity to correct  problems.
 
6. EVENT RENTAL EQUIPMENT (Margarita Machine, Concession Items, Tables & Chairs, Linens, Canopies, Dance Floor, BBQ, Generators, Serving Equipment) : 
· JOLLY BOUNCERS does not supply liquor for the margarita machine. This unit will be shared with others over whom JOLLY BOUNCERS has no control. 
· If you become aware of any potentially dangerous condition, correct the action of participants or notify JOLLY BOUNCERS immediately.
· All edible accessories purchased from Jolly Bouncers are delivered unopened.
· Machines must be cleaned and returned in same condition as when received, ordinary wear accepted. If not cleaned, a $20 cleaning fee/ item will be applied to the credit card on file.
· Lessee will be responsible for any damage to the unit or item. If Item is damaged or not returned, lessee must reimburse Jolly Bouncers the price to replace item.    
 
7. MAINTENANCE AND RETURN: Lessee agrees to keep the JOLLY BOUNCERS unit in the same condition as when received and will be responsible for any damages to the unit, ordinary wear accepted. Lessee also represents and warrants the safe return of the unit and hereby agrees to pay four thousand dollars ($4,000) if the unit is stolen/not returned for whatever reason. 
 
8. ALTERATIONS AND ATTACHMENTS: No alterations in or attachments to the JOLLY BOUNCERS unit will be made without prior written approval of lessor. 
 
9. WARRANTY: Lessor warrants that the JOLLY BOUNCERS unit leased under this Rental Agreement will be in good working order on the effective date of the Rental Agreement.  The JOLLY BOUNCERS unit is supplied and maintained subject to this warranty.  Lessor’s obligation under this Rental Agreement is limited to repair or replacement of the JOLLY BOUNCERS unit when Lessor determines that is does not conform to this warranty.  This warranty is in lieu of any and all other warranties expressed or implied, and of any and all obligations and of all liabilities on the part of the Lessor for damages, including, but not limited to consequential damages, arising out of or in connection with the use or performance of the JOLLY BOUNCERS unit. 
 
10. TITLE TO JOLLY BOUNCERS: Lessee agrees to keep the JOLLY BOUNCERS unit in his/her custody and not to sublease, rent, sell, remove from the Delivery Address, or otherwise transfer such JOLLY BOUNCERS unit. All units will remain the property of the Lessor and may be removed by Lessor at any time after the termination of this Rental Agreement. 
 
11. RECEIPT OF UNIT IN GOOD WORKING ORDER:  The receipt of the JOLLY BOUNCERS unit that is the subject of this rental agreement is in good working order and repair and this is so acknowledged by lessee. If you feel that the driver has not done a satisfactory job in the setting up the unit, please call 805-955-9802 immediately.
 
12. RAIN POLICY: During periods of severe weather conditions (I.E. rain, high winds, etc.), we reserve the right to cancel your reservations.  If conditions are not severe we will give you the option of keeping your reservation.  If you decide to keep the unit for the term of this Rental Agreement, there will be no refunds.  If you decide to keep the unit and it rains, a $25.00 dry fee will be charged to the credit card. 
 
13. RELEASE OF LIABILITY: 
Understanding that all reasonable precautions have been taken to assure that Jolly Bouncers units are as safe as possible, I understand that Jolly Bouncers units have inherent risks and may result in serious injury. I further understand that the inflatable will be shared with others over whom Jolly Bouncers has no control.
I knowingly and freely accept and assume all risks, both known and unknown, and agree to release, defend, indemnify, not sue, and hold harmless Jolly Bouncers, it’s principals, employees, and agents from any and all claims, damages, injuries and expenses arising out of, or resulting from my voluntary use of Jolly Bouncers units or the voluntary participation of those for whom I am responsible.
I willingly agree to comply with the stated and customary terms, rules and conditions for participation; and if I become aware of any potentially dangerous condition I will correct the action of participants or notify Jolly Bouncers immediately.
I have read the above release and assumption of risk acknowledgment and agree to be bound by it for myself and all participants, and as the parent/legal guardian/custodian* (*custodian: in acting as legal guardian/ custodian, even temporarily, I accept all conditions above for the minors in my custody or control and I have the permission from the minor’s family or other responsible party to cover them under this agreement). I hereby give my consent for all participants under 18 years of age for whom I am responsible.   
14. AGREEMENT TO ARBITRATE:  it is understood that any dispute will be determined by submission to arbitration as provided by California law, and not by a lawsuit or resort to court process except as California law provides for judicial review of arbitration proceedings. Both parties to this contract, by entering into it, are giving up their constitutional rights to have any dispute decided in a court of law before a jury, and instead are accepting the use of arbitration. 
 
 
BY SIGNING THIS CONTRACT YOU ARE AGREEING TO HAVE CAREFULLY READ AND FULLY UNDERSTAND ITS CONTENT. YOU ARE ALSO AGREEING TO HAVE ANY ISSUE DECIDED BY NEUTRAL ARBITRATION AND YOU ARE GIVING UP YOUR RIGHT TO A JURY OR COURT TRIAL. SEE ARTICLE 14.
